Salam. Malam, wata ce ta yi cikin shege da wani mutum, sai ta nemi wani daban ya rufa mata asiri ya aureta, yanzu haka ya aure ta. Mene ne hukuncin auren?
Wa’alaikumus salam. Zina sabon Allah ce da kuma yaɗa fasadi a bayan ƙasa. Aure kuwa, sunnar Manzon Allah ne da samar da zuriya mai albarka, sannan kuma an kwaɗaitar da mu yin sa.
Amma Mazhabar Malikiyya, suna ganin matar da aka yi zinar da ita, sai ta yi jini wanda ake kira Istibra’i, kafin a ɗaura mata aure, domin a raba maniyyin zinar da na aure. Kuma idan har an ɗaura aure ba ta yin wannan jinin ba, to za a raba wannan auren ko da sun haifi ƴaƴa, domin suna ganin an ɗaura auren ne a cikin idda, kuma Allah ya hana ɗaura aure a cikin idda. Saboda haka, a wurinsu, wannan auren batacce ne kuma rusasshe.
Amma Mazhabar Abu Hanifa da Imam Shafi`I, suna ganin macen da ta yi zina, an so ta yi istibra’i kafin ta yi aure, amma idan har an ɗaura auren ba ta yi istibra’i ba, auren yana nan daram, ba za a raba su ba. Kuma suka ƙara da cewa, ko da tana da cikin zinar ne aka ɗaura mata aure, to auren yana nan. Sai dai, Imam Abu Hanifa ya ce; mijin da ta aura, ba zai sadu da ita ba, har sai bayan ta haihu, ko da kuwa cikin zinar nasa ne ko na waninsa.
Annabi tsira da amincin Allah su tabbata a gare shi ya ce, “Duk wanda ya yi imani da Allah da ranar lahira, to kada ya shayar da ruwansa ga shukar waninsa,” Abu- dawud 1847.

A fahimtata, fatawar Malikiyya ta fi inganci kafin a yi auren, saboda fita daga sabanin malamai abin so ne, sannan kuma za a kaucewa faɗawa haɗari, amma idan an riga an yi auren, to fatawar Hanafiyya abar lura ce, saboda akwai bambanci tsakanin zina da aure, sai dai ya wajaba su nisanci saduwa kafin ta haihu, saboda hadisin da ya gabata.
Allah ne mafi sani.
